WHAT IS BETTERID?

BetterID is a user-friendly identity verification platform that simplifies the KYC process and supports compliance across the real estate sector and other regulated industries. As the first step in the home buying and bond application journey, it removes long-standing FICA-related hassles through seamless digital onboarding. BetterID (“we” or “our”) is committed to maintaining the confidentiality of your Personal Information, which will be processed and secured in accordance with POPIA and applicable data protection laws. We will take all reasonable precautions to prevent unauthorised access, loss, or destruction of your Personal Information.

Your information will be processed for the following purposes:

To provide BetterID Services, including identity verification and compliance screening;

To fulfil legal obligations and contractual requirements;

To support fraud prevention, risk assessment, and regulatory reporting.

By accessing and using the BetterID Platform (“Platform”) and BetterID Services (“Services”), you (“Consumer”) agree to comply with these Terms and Conditions (“Terms”). Some words in these Terms have specific meanings. You can find these in Schedule A: Key Terms at the end of this document.

You must be at least 18 years old and have the legal capacity to enter into binding agreements to use our Services.

OUR SERVICES OFFERED

Verification Services:

Identity Verification (IDV): Using facial recognition or photo comparisons to confirm your identity against official records;

Physical Address Confirmation: Confirming your physical address by matching credit bureau information with details provided by you;

Sanction Screening: Screening your name against national and international watchlists to meet legal requirements;

PEP and PIP Screening: Identifying whether you, your associates or your family members hold or are linked to prominent public or influential roles;

Adverse Media Screening: Searching public sources for negative news that may affect your verification;

Additional Verification Services: Other checks like credit reports may be offered if requested by a Customer and provided that such Services have been approved by you.

To complete these services, you may be asked to:

Log in securely to the BetterID Platform;

Respond to verification requests from authorised third parties;

Confirm your identity using biometrics or personal information;

Provide and verify your address;

Consent to share your information with relevant parties.

You will be notified immediately if your verification is successful. If not, you may be asked to upload further supporting documents (like your proof of address) to continue.

YOUR RESPONSIBILITIES

When using our Platform, you warrant and represent that you will:

Provide accurate information and cooperate with verification steps;

Keep your login details secure;

Use the platform responsibly and lawfully.

If any incorrect or misleading information results in service limitations or regulatory reporting, we may take appropriate steps in line with applicable laws. This clause does not limit your rights under the CPA.

HOW WE USE AND PROTECT YOUR DATA

By using the Platform, you agree that we may collect, process, use and store your personal information to verify your identity, meet legal and regulatory requirements (including FICA, NCA, POPIA), and deliver our Services. This may include sharing your information with authorised third parties, but only with your consent or where required by law.

To improve your experience, we use cookies — small data files that help us log you in securely and understand how the Platform is used. You can manage your cookie preferences in your browser settings, but disabling certain cookies may affect access to our Services.

We protect your data using secure storage, encryption, and access controls, in line with POPIA and other applicable laws.

For more detailed information on how we collect, use, store, and retain your personal information, including the applicable retention periods, please refer to our Privacy Policy. This policy forms part of these Terms and explains your rights and our obligations under applicable data protection laws, including POPIA, FICA, NCA.

YOUR RIGHTS

You have the right to access, correct, or delete your information, and to withdraw consent (though this may affect service delivery). For more detail regarding this, please refer to our Privacy Policy.

You won’t be charged for verification services — these are paid for by the third party requesting them. We will never ask you for payment.

SAFETY FIRST (AND LEGAL TOO)

We take your privacy and data security seriously. We use industry-standard safeguards like encryption, secure storage, and access controls to protect your information. While we do our best to keep your data safe, please note that no internet-based system can be 100% secure.

All electronic interactions, consents, and records on the Platform are legally valid under ECTA. All data processed through the Platform is stored securely in our BetterID Data Lake to ensure compliance with legal and regulatory standards.

We own the Platform and its content.

ENDING YOUR USE OF THE PLATFORM

We may suspend or stop your access to the Platform if you breach any of these Terms or engage in unlawful activity. Once access ends, you’ll no longer be able to use the Platform or Services. Your personal information will be retained only for the purpose it was collected, unless required by law or for compliance. You may request deletion of your information, and we’ll do so unless we’re legally required to keep it.

We may update these Terms from time to time to reflect changes in law, technology, or our services. By continuing to use the Platform, you accept the updated terms.

If we are ever acquired or merged with another company, we may transfer our rights and responsibilities under these Terms to that company. We will make sure your rights are not negatively affected.

LEGAL STUFF

We are not liable for any damages arising from your access and use of the Platform and Services, including but not limited to loss of data, profits, or business interruptions. Our maximum aggregate liability for any claim brought by you shall be limited to the total fees paid for the Services directly related to the claim in the 12 months preceding the claim.

If you have a concern, contact our support team. In urgent cases, either party may seek help from a court.

These Terms are governed by the laws of the Republic of South Africa.

SCHEDULE A: KEY TERMS

To keep things simple and clear, we’ve defined key terms used in this agreement. These definitions help you and BetterID understand what we mean and what to expect wherever these terms appear.

  1. AML/CTF means Anti-Money Laundering and Counter-Terrorism Financing regulations applicable to financial and identity verification services.
  1. BetterID means BetterID Proprietary Limited, a private company incorporated in accordance with the laws of the South Africa, with registration number 2024/355753/07 offering its services through its platform.
  1. BetterID Platform means the software application that is proprietary to or licenced to BetterID that will act as an interface between TGPDC, Customers and Consumers.
  1. BetterID Services means the services selected by the Customer as described in clause 2.
  1. Cookies means small data files used by the BetterID Platform to enhance user experience, including authentication and analytics cookies.
  1. Consumer means an individual of entity (also known as a data subject) who accesses and uses the BetterID Platform and Services for identity verification and compliance purposes.
  1. CPA means the Consumer Protection Act, No. 68 of 2008.
  1. Credit Report means consumer credit information that includes details about your credit history, financial standing, and personal identifiers that are used to assess your creditworthiness in terms of NCA. A Credit Report is a summary of this information compiled by a registered credit bureau, which helps credit providers make informed decisions.
  1. Customer means the third party (Agency or Institution) that requests verification services from BetterID.
  1. Data Lake means a secure storage repository used by BetterID to store and manage personal information with encryption and audit trails.
  1. ECTA means the Electronic Communications and Transactions Act 25 of 2002, as amended, which governs electronic communications, data messages, and the validity of electronic transactions in South Africa.
  1. FICA means the Financial Intelligence Centre Act 38 of 2001, as amended, a South African law requiring institutions to verify customer identities and report suspicious activities.
  1. KYC means “Know Your Client”, a regulatory process used to verify the identity of clients to prevent fraud, money laundering, and other financial crimes.
  1. NCA means the National Credit Act 34, 2005 as amended.
  1. PEP means Politically Exposed Person, an individual who holds or has held a prominent public position, including their family members and close associates.
  1. PIP means Prominent Influential Person, a person who holds a position of influence in public or private sectors, similar to a PEP, including their family members and close associates.
  1. Personal Information means any information that can be used to identify a person, including names, ID numbers, addresses, and biometric data.
  1. POPIA means the Protection of Personal Information Act 4 of 2013, as amended, a South African law that governs the processing and protection of personal information.
  1. TGPDC means The Good People Data Company Proprietary Limited, a registered credit bureau and private company incorporated in accordance with the laws of the South Africa, with registration number 2018/405198/07 and Credit Bureau number NCRCB63.
  1. Verification Services means the Services provided by BetterID to confirm identity, address, and compliance status of a Consumer.
